Article 1 - Purpose
These General Terms and Conditions of Sale (GTCS) define the rights and obligations of ESTUDIAL SAS (hereinafter “the Provider”) and the client in connection with student mobility support services, including academic counselling, administrative assistance and housing pre-booking.
Article 2 - Services offered
They include:
- Review of study plans, guidance on programme choices, support in preparing application files (admission, enrolment, etc.)
- Search for suitable accommodation solutions and pre-booking with selected partners
- Support with administrative procedures (insurance, visa, banking, etc.)
- Help with settling in (welcome on arrival, practical information, etc.)
- Social and cultural integration through introductions and dedicated activities
Article 3 - Order and acceptance
The order is placed via the ESTUDIAL platform or any contractual form, evidenced by electronic or handwritten acceptance of the GTCS.
By confirming the order, the client declares that they have read and accept the GTCS without reservation.
Article 4 - Prices and payment
Current prices are displayed on the platform and confirmed before final validation of the order.
Payment is due in full when the order is placed. Accepted payment methods are specified on the platform.
No refund is possible after the service has started, except where the statutory right of withdrawal expressly applies (see Article 7).
Article 5 - Nature of the commitment and limits of the service
ESTUDIAL’s mission is an obligation of means, not of results.
Pre-booking accommodation, preparing a file or obtaining a visa does not make the Provider liable for the final decision of third parties (landlords, consular authorities, etc.).
ESTUDIAL is not a real estate agent, does not collect rent or security deposits, and is not involved in drafting or signing leases.
Article 6 - Client obligations
The client undertakes to provide accurate, complete and up-to-date information.
Any false statement or wilful omission will result in exclusion from the service without refund and may lead to administrative or criminal penalties.
The client will provide all supporting documents required for proper performance of the service.
Article 7 - Right of withdrawal
Individual clients have a statutory 14-day withdrawal period from the order, unless they expressly request in writing that performance of the service begins immediately (which waives this right).
The withdrawal request must be sent by registered post or email with acknowledgement of receipt.
Article 8 - Confidentiality and data protection
Data sent to ESTUDIAL is processed solely for the performance of the service, in compliance with the GDPR.
Data controller: ESTUDIAL SAS.
The client has the right to access, rectify, erase and port their data, by request to contact@estudial.com.
Data is never resold to third parties.
Article 9 - Liability
ESTUDIAL’s liability is strictly limited to the amount actually paid by the client for the subscribed service.
ESTUDIAL cannot be held liable in the event of visa refusal, failure to obtain housing, or any act of the client or a third party not contractually bound to ESTUDIAL.
Article 10 - Force majeure
In the event of an external, irresistible and unforeseeable event preventing performance, the parties’ liability is suspended. This includes conflicts, strikes, natural disasters, exceptional administrative decisions, etc.
Article 11 - Termination
Early termination is possible by either party in the event of a serious breach of obligations, after formal notice has remained ineffective for 15 days.
No refund is due for services already performed.
Article 12 - Applicable law and jurisdiction
The GTCS are governed by French law.
In the event of a dispute, jurisdiction is expressly assigned to the courts of the place of ESTUDIAL SAS’s registered office, unless mandatory rules provide otherwise.
Article 13 - Contractual acceptance and updates
The client acknowledges having read and accepted the full GTCS.
The GTCS may be amended at any time by Estudial. Only the version in force at the time of the order applies.
